The relationship between authority – understood as the totality of public powers – and freedom has, since the Enlightenment revolution, been at the centre of debates of all kinds (philosophical, political, theological). nature (philosophical, political, theological). But it is above all the legal synthesis to find a difficult composition. The Republican Constitution itself attempts to mediate between authority and freedom, however, the Constituent could not have imagined the complete social upheaval that has taken place over the last twenty years. In the face of such a scenario, it is therefore necessary to elaborate a contemporary form of synthesis of the rights of liberty in the relationship with public powers.
